Buyers Need To Be As Committed To You As Sellers Are

Rumbling around the archives in the 'Rain today sparked this post.

 

I know the "legality" of what follows varies from State to State and perhaps Province to Province for our Canadian members.

 

I think I'm on "solid ground" proceeding on the basis that in all jurisdictions some sort of "Listing Agreement" is required between Listing Broker and Seller in advance of the listing going "Active" in the MLS.

 

I also think, based on what I've read here, that even if it were not a requirement, there are very few, if any, Listing Brokers, who would not insist on a signed Listing Agreement even if it was "optional".

 

I've read in that in some jurisdictions a Buyer Broker Agreement (the equivalent of a Listing Agreement with a Seller) is required.  

 

I have not read, but will allow, that it might be prohibited in some jurisdictions.

 

I know that it is "optional" in some jurisdictions, Arizona being one of them.

 

We ALWAYS - yes - ALWAYS have a Buyer Broker Agreement in place with a Buyer, just as we have a Listing Agreement in place with a Seller, BEFORE spending any time, effort or expense.  In our opinion it's just good "business".

 

But - I know there are others who disagree and don't use them.

 

And I've read both on blog posts and in the Q&A of situations that happened to fellow 'Rainers that could have been prevented, or at least mitigated, by having a Buyer Broker Agreement in place.

 

 

 

I'm really curious why Buyer Brokers, who have the option to use a Buyer Broker Agreement with their Buyers but choose not to, make that choice.

 

Any ideas?
