MLS Offers of Compensation - What are Buyer Agents ENTITLED to?

There appears to be a lingering perception in the minds of some Buyer Agents who have been around for a while that no matter what the total commission paid by the Seller is, the Buyer Agent is automatically and indisputably entitled to 50% of the total commission.

What's more, when they become aware that's not the case - some of them behave atrociously.  They wail......

"You're GREEDY!"

"You're UNETHICAL!"

"That's ILLEGAL!"

What they fail to realize is that this behavior is:

1. A violation of the REALTOR Code of Ethics and

2. makes them look like total morons!

Nothing prevents any Buyer Agent from establishing their compensation with their Buyer in a Buyer Broker Agreement.  

If the compensation offered in the MLS is equal to or exceeds that amount, the Buyer does not have to  contribute to the Buyer Agent commission.

If the compensation offered in the MLS is less than that amount, the Buyer contributes to the Buyer Agent commission.

Why a Buyer Agent would work with a Buyer without a Buyer Broker Agreement is unfathomable.

Would they take a listing without a Listing Agreement?!

The conclusion will no doubt irritate some of these Buyer Agents, because the truth can be very irritating.

They simply aren't "strong" enough to secure a Buyer Broker Agreement with their Buyers.  Instead they rely on the Listing Agent to establish the compensation offered in the MLS, and if they think they are entitled to more, they squawk!

Worse yet, some of them will tell prospective Buyers that the Listing Agent is "not offering a co-broke" or better still "not offering a FULL co-broke"!  What on earth is a "full" co-broke?!  There isn't any such animal!! 

It would be far simpler, and far more professional, to secure a Buyer Broker Agreement (if the Buyer Agent is dead set on a certain amount of compensation) with their Buyer.

If a Buyer Agent does not choose to have a Buyer Broker Agreement with their Buyers, they have no business moaning and whining about the compensation offered in the MLS, particularly after they have shown the property and written an offer!

Wow "full co-broke" I haven't heard that one before.

If it's not a 50/50 split, more often than not, I see the listing agent receiving less commission than buyers agent.

I notice this most in our short sale market.  When compensation is listed at 2.5% and the lender ends up paying a 6% commission.  I understand when a listing agent isn't going to split the commission 50/50 but it's also a nice surprise when the buyer's agent is offered 1/2.  Buyer's agent's certainly should not be expecting more than is listed in the MLS no matter what the listing agent is getting.

Amy - I agree 100%. It's unfortunate that we can't put any remarks in the MLS that highlight the fact that we can pay more if there is more - and if the Buyer Agent has pulled their weight on the deal - but ARMLS rules preclude comments about changes in commission to Buyer Agents. I can say typically it is 50/50 in our area.  However, that being said, if the listing agent is able to get for example 7%, they will only split 4% Listing Side, 3% Selling Side.  However, it is disclosed on the mls such a split.  The ones we run into the most problem are with the ones where the commission is much lower and the split is ludicrous.  For example, they may charge the Seller 5% and split 2.75 Listing Side and 2.25 Sale Side.  What comes into play here is another form that can be submitted with the Agreement of Sale to have a higher commission paid to the Selling Agency for example 50/50 if the contract is ratified.  Also in certain cases we see bonus's being offered.

I understand the premise behind the post but there is nothing more aggravating when you bust your bum on a transaction & found out the other agent that did nothing is getting paid more than you!  It is not a violation if you discuss the commission BEFORE you show it.

Are you greedy? Do you pay out half? Do you pay out more than the going commission for your area? Do agents know that you will pay well to show your listings?

I came from a reblog.

In our area I do not know a single agent here who gets the Buyer broker agreement. I do not ask for it. Maybe it is the market, but if agents do not do it, there should be a bigger reason than just being plain stupid.

When we get the HUD and see that the commission is not split 50/50, and there is no reasonable explanation, we are not happy.

If for whatever reason we are offering less than half of our "apples" to the cooperating broker, we disclose it. I do not want the anger wen they get to the closing table.

I agree wiith Lyn, I do not like surprises like this at closing.

Thanks for stopping by.  Let me take those points one at a time.

It is not a violation if you discuss the commission BEFORE you show it.  Agreed - In fact - It's not a violation even if you ask after the fact.  It's the attitude and claims of the listing agent being "unethical" that is the violation of the COE.

Are you greedy? Define greedy.

Do you pay out half? Half of what?  The total commission? The total commission less expenses? Or....??

Do you pay out more than the going commission for your area? No such thing as "going" commission.

Do agents know that you will pay well to show your listings? "pay well" - again a vague concept.  Agents know what compensation is offered as it is clearly stated in the MLS listing.

One thing absent from your comment was any observation regarding Buyer Agents using Buyer Broker Agreements to define their commission.  I would welcome your thoughts on that!

Hi Tony and Suzanne,

I understand what you're saying about agents' bad behaviour - no matter what the situation it's important to always stay professional.

But what I don't understand is why, as the listing agent, 50% wouldn't be offered to the co-operating brokerage? What is the reasoning behind that?

 Personally, I couldn't imagine not offering 50%. Buyer's agents are just as important as seller's agents - without a buyer the house doesn't get sold.

Hi Pam,  The Listing Brokerage is entitled to determine what compensation they offer in the MLS.  There is no requirement that it be 50% of the total commission. What I'm hoping to hear is WHY some Buyer Agents assume that they are entitled to 50% of the commission negotiated by the Listing Broker with the Seller, when the Buyer Agent has the freedom to negotiate their compensation with their Buyer.

Hi Tony and Suzanne,

I understand the listing brokerage can offer what they wish. Around here CREA dictates that on the MLS listing they MUST offer something, but it doesn't have to be 50%.

And I understand that you would like to know why the buyer's agent feels they are entitled to half and why they just don't use the agreement to make sure they get half.

But, perhaps answering my question, why NOT give 50% to the buyer's agent, answers your question.

When a buyer's agent brings in a buyer, have they not worked as hard as the seller's agent to get a deal together to get that home sold?

Also, as a bit of a side note: When a house gets listed on MLS it is hopefully listed with a price set by using comparables. Those comparables are found on MLS where other homes have been sold by agents which means all the commissions have been included in the housing prices. This means buyers are already paying for the commissions, so how fair is it that agents should try to get more from them, because the listing agent isn't offering 50/50?

I'm not trying to be hard to get along with. I'm asking because I've worked both sides of the fence and am trying to understand your point of view.

Hi Pam,

Your discussion and comments is much appreciated.  As an aside - I hail from Hamilton, Ontario!

"Those comparables are found on MLS where other homes have been sold by agents which means all the commissions have been included in the housing prices."  Not necessarily - Buyer Agents could have used Buyer Broker Agreements for some of those transactions.

When a buyer's agent brings in a buyer, have they not worked as hard as the seller's agent to get a deal together to get that home sold?  I honestly can't answer that.  These days Buyers are instructing Buyer Agents as to what properties to show them - as they find them on the Internet. 

We used to work with Buyers, and we have 8 Buyer Agents who work the Buyer Leads from our listings, and I always used a Buyer Broker Agreement so it was irrelevant to me what was offered in the MLS.  I just had to make sure the Buyer understood the Buyer Broker Agreement and the ramifications.

That said - on a "regular resale" we may well offer a 50% split - or compensation that is in line with the top of the bell curve for our market.

With Short Sales (currently 95% of our business) there are other expenses not encountered in regular resales, which means it's prudent to divide the total compensation in a way that makes sense for the Buyer Agent and the Listing Agent after those expenses come off the top.

The main point I'm trying to make is that:

1.  Buyer Agents know the compensation offered before showing a listing because it's in the MLS.

2.  If that isn't sufficient - nothing prevents them from negotiating with their Buyer for additional compensation.

Since that's the case, what is your opinion of those that don't pay attention to the co-broke, don't bother to have a Buyer Broker Agreement with their Buyer, and then squawk about their "entitlement" to a 50% split of the total commission?

Excellent post.

Their can be allot of reason for a disportant split, greed is only the most common.

I'm sorry if this offends, Buyer's Agents with out a Signed BBA  should be grateful for any bone thrown their way!

Agency opened the door for professionalism, but many have used it to become a hack!

Professionals know their own value and set their own fees! Hacks know their value and bitch when they're not over paid!

PS: I think the problem is that most Buyer's Agents ask for long term exclusive contracts from strangers! If you'd ask property specific agreements (LIMITED TO THE PROPERTIES YOU SHOW THE CLIENT.) you'd have allot less resistance!

Tony and Suzanne, This is a very interesting blog on the topic of BBAs.  Agents do not use them so much in my market area, although I have used them.  Buyer's agents' commissions are becoming more of an issue, not only because of the MLS compensation being offered the selling agent, but because buyers are using the internet to shop first. 

William #19 made an excellent point, "...the problem is most Buyer's Agent's ask for long term exclusive contracts from strangers!"  This is so true when often I may be showing properties to buyers I've just met!  I agree that asking for property specific agreements may be a solution to buyer's agents' commission if the issue arises.

If an agent chooses not to use BBA's, then they really have no reason to complain if the commission split is not 50/50.  This blog is definitely food for thought, thanks,

Sorry for the delay with getting back to you - yesterday was a holiday. From Hamilton, huh? My daughter lives in Hamilton. Just finished her last year of Advertising at Mohawk :)

Now - about the comparables...I understand not necessarily, but I think you'll agree that in general commissions are included in the final sale price of the house (at least around here they are).

Also, I'm not sure the Internet has made a buyer's agent's job easier - just different. As it has the entire industry.

Yes, buyers can research on their own, and they feel more educated, but that can make an agent's job harder, not easier. When someone "feels educated" they have a tendency not to listen to the professional's advice and they are all over the place - like kids in a candy store. Plus, because they can do their own research they don't see the value in using a buyer's agent except to submit an offer, which makes getting them to sign a Buyer's agreement that much more difficult. Also, Buyer's like to use multiple agents for they feel that way they have more people working for them - it's hard to convince them otherwise, making that another hurdle for the agent.

I think those that don't pay attention to the co-op agreement on MLS aren't doing their jobs. The most vital skill we should possess as agents is to pay attention to detail and they haven't done that if they weren't aware of what was being offered in the form of compensation.

I think Buyer's Agreements are difficult to get signed. They aren't like the seller's listing agreements, so buyers will always find that agent who won't insist on a contract - several agents, in fact, who will gamble that they will ultimately get to submit an accepted offer and get paid. As long as there are agents who don't use them, there will be buyers who will continue to use many agents at once. That's why I usually don't work with buyers. If they won't sign, I won't represent them, so they go off and find an agent who will help them without a contract and there are plenty of them around.

As far as a buyer's agent using a Buyer agreement to get what he feels is his fair share, Under the current system, I'm against it. I think a Buyer agreement should be used to show a loyal relationship between professional and client and to protect the buyer agent so he will get compensated if the client decides to go off and buy privately. Not to make sure he gets a 50% split.

Want my solution to the whole problem? Change the system. Seller pays his agent - buyer pays his agent. That way the line between who's working for who is no longer blurred.

We can't talk specific numbers here - however - I will say that our Buyer Broker Agreements always called for an amount that was usually higher than that offered in the MLS - and was not designed to get a 50% split - it was designed to secure the fee that we charge, regardless of the compensation to the Listing Agent.

You and I are on the same page here.  I've said for years that it's coming, and eventually, it will.

You wrote this in 2010, and I'm sure hoping not getting Buyer Agreements is a thing of the past.

Alas, I just started working with a set of buyers and they had left their first realtor.  When I asked if they'd gotten a release of their Agency Agreement with him, they were confused.  When I reminded them they'd signed a Buyer Agreement with him, their confusion remained and they swore, they'd never signed anything.    Sheesh.  Now that have with me.
