I wrote a post about a week ago asking the question:
I was pleasantly surprised to see the post featured, and because of the "gold star" many Active Rainers chimed in on the issue.
Without recounting the details of all 127 comments, the discussion left me with this impression.
While many were quick to opine that one shouldn't "call out" another agent who is guilty of blatantly lying about their Short Sale track record, no-one was of the opinion that to do so was "unethical".
Lisa Orme posted what I thought was a truly brilliant comment (#27 on the original post) pointing out that until 1992, when Article 15 was amended, it would have been unethical, but since that amendment it was no longer unethical. An interesting piece of history!
Many offered solutions/approaches to dealing with the situation in other ways, and from those comments the following "game plan" has emerged.
1. Use the MLS data to "measure" production and list to close ratios.
2. When observing a difference between the MLS produced metrics and the claims made by the agent/team/brokerage, ask them to explain the discrepancy.
3. If they decline to explain the discrepancy or to correct the advertising, file the appropriate complaints with the Department of Real Estate.
To reiterate, the concern here is for stressed out consumers making ill advised choices based on false advertising, choices they may well not make if they knew the truth.
With Short Sales, an ill advised choice based on false advertising could haunt the consumer for years to come.
