Avoiding One Of Many Possible Surprises!

"Surprises" defined for the purpose of this post.

 

 

 

 

 

"glitch, setback, delay, technical hitch, your word(s) of choice"

 

We do our best to help our clients avoid "surprises".

 

When representing Sellers we recommend including language in the contract that, in our opinion, "balances" the contract by eliminating or clarifying some of the Buyer Contingencies to ensure (as much as possible) that the Buyer is "sincere" and "able".

 

In Arizona, it's legal for Real Estate Brokers (and agents) to write clauses for the contract.  CAVEAT: We ALWAYS run "custom clauses" past our Designated Broker and their legal counsel BEFORE we recommend them to a Seller. 

 

We are aware that this is not possible in some states.

 

One thing that does appear to be possible, regardless of location, is the ability to order a preliminary title report.  

 

The above statement is based on recent responses in the Q&A to the following questions:

 

Do you order a preliminary title report on the property before you accept a listing?

 

 

Have you ever had a listing where liens, encumbrances or "other surprises" did not become "known" until after the property was in contract, and what happened - "close" or "no close"?

 

 

 

It is standard practice for us to have a preliminary title report ordered prior to a listing going Active on the market.

 

 

It helps to eliminate at least one of the possible "surprises" that may threaten to derail the sale of the listing.

 

We would much rather know about any liens, encumbrances, "problems" in advance than have to deal with it later when it becomes a "surprise"!

I agree that this is a good idea and it helps to know where your seller stands financially in the transaction. I have done it on occasion, but it's not my standard practice. In 20 yrs, I've only had one surprise where something came up and we had to take steps to take care of it.
