Contracts and Clauses

One of the "value adds" we bring to the table for our Sellers and Buyers, is that in Arizona, real estate brokers are expressly authorized to create real estate contract "language".  I know that this is not the case in many other jurisdictions, so this is NOT to be construed as legal advice.

Once we entered the real estate business, we noticed things "happening" that could have reasonably been foreseen to occur, and therefore could have been addressed in both the Listing Agreement and/or the Purchase Contract, but were not in the boilerplate Listing Agreement from ARMLS, or the Purchase Contract provided by the Arizona Association of REALTORS®.

 

In posts over the next few weeks, I plan to highlight "boilerplate" clauses that we have either modified or enhanced for the benefit of our clients - both Sellers and Buyers, provide the language we include in our Addendum to benefit our clients, and explain why we believe it's in their best interest.

 

Not everyone will agree with the modifications we suggest.

 

I will tell you that every clause in our Addendum has been reviewed closely by several prominent Designated Brokers and Real Estate Attorneys around town and were deemed "rock solid".

 

And I will also tell you that it's never prevented one of our Buyers from Buying or one of our Sellers from Selling.
