Seller's Disclosure Of Material Facts - It's The LAW In Arizona!

Whether a Seller of residential real estate attempts a "For Sale By Owner", or hires a Listing Broker to help them sell their home, they are legally required to disclose all material (important) facts about the property - even if they are not asked by a Buyer or a Real Estate Agent.

 

The Arizona Association of REALTORS® (“AAR”) Residential Resale Real Estate Purchase Contract requires the seller to deliver “a completed AAR Residential SPDS form to the Buyer within five (5) days after Contract acceptance.” If the Seller does not provide the SPDS as the Contract requires, the Seller is potentially in breach of the Contract, and the Buyer could possibly cancel the transaction and receive the earnest money deposit.

I always say the same thing...disclose now rather than in court later!  I actually put it like "what would you like to be told if you were buying?"  Sellers seem to understand - as far as I know!

And it's not just law in Arizona... here, too, in the Carolinas. Failure to disclose material facts put you into a world of hurt if you're caught.
